Terms of Use
Every employee deserves to work in an environment where healthy behaviour is a given. The inspiring and energising approach taken by Halo helps employers and employees to make healthy behaviour a logical choice. Your participation in the programme is at all times voluntary. By opting to participate, you agree to these terms of use applicable to the application.
Halo is part of Arbo Unie B.V. and has its registered office at Nevelgaarde 42, 3436 ZZ Nieuwegein. Arbo Unie is not reliant on investors and can guarantee full independence. On behalf of Arbo Unie, Halo would like to inform you about which terms of use apply to the full Halo programme.
The use of Halo involves the processing of personal data. In processing personal data, Halo of course complies with its statutory obligations, including those under the General Data Protection Regulation (GDPR). You can find more information about the processing of (your) personal data in our privacy statement.
- What technical aspects should I take into account?
As a participant, you should ensure that your smartphone and the email address you use to access the application meet the necessary technical requirements and that the network connections and other technical conditions, including the security thereof, are adequate and up to date. We have made every effort to observe the utmost care in developing and applying the application (including with regard to content, such as text, images, videos and music). Halo supplies the application on the basis of a best-efforts obligation. This means that Halo will endeavour to make the application available to the best of its ability and with due care. However, Halo does not guarantee a perfectly functioning application and uninterrupted availability and/or the completeness or correctness of the content. If the application does not function, you can of course contact us. Halo offers the application “as is”, without room for individual modification. The use of the game and its content is entirely at your own risk.
- Liability
As a participant, you are personally responsible and liable for the use of the application, such as with regard to (but not limited to) the performance of assignments, the use of recipes and acting on content in the application. Your login details are strictly personal and you are responsible for the lawful use thereof. This also applies if you wish to consult a physician in connection with any allergies or impairments or for medical advice in relation to the game. Halo will not be liable for any loss, damage or injury, including any physical damage or injury and/or mental injury, suffered due to the use of the application and the content of the application, except where this loss, damage or injury is caused by or due to actions by Halo in violation of the law, or failure by Halo to comply with the provisions of these terms of use, or intent or wilful recklessness on the part of Halo.
- How do you deal with maintenance, adjustment and improvement of Halo’s online environment?
We have the right to temporarily deactivate Halo’s online environment for maintenance, adjustments or improvements to this environment and/or related systems and/or to resolve any malfunctions. This is done as much as possible outside office hours, in order to minimise any impairment of the ease of use. Where possible, we will inform you of this in advance. Maintenance may lead to changes to the online environment that alter the functionalities in the online environment. We cannot guarantee that all functionalities of the online environment will remain available at all times.
- Who owns the intellectual property rights and when can I use Halo?
All intellectual property rights in respect of Halo’s online environment will remain vested in Arbo Unie or its licensors. This means that you may not copy, offer, disseminate, sell, rent, transfer, (sub)license, distribute and/or make available anything to third parties. Arbo Unie hereby grants you a non-exclusive and non-transferable right of (sub)use solely for the term of the agreement entered into with your employer (or until the date of termination of the use by your employer). You may only use the app yourself (or designate one buddy). If you designate a buddy, this buddy will also use the app as a participant and these terms of use and the privacy statement will therefore also apply to this buddy as a participant. You are personally responsible for everything you share with this buddy. For more information, please refer to our privacy statement. It is not permitted to decompile (all or part of) the software, remove the code, reproduce or translate the code or otherwise subject it to reverse engineering. Arbo Unie is entitled to terminate the possibility of the use of Halo at all times.
- What arrangements apply to the right of use?
You will receive your personal invitation to participate in the online part of the Halo programme by email. We recommend that you use a strong password (such as a combination of numbers and letters).
Data and/or results will not be shared with your employer in any form by means of which you would be identifiable from this information. We do sometimes provide information to your employer in the form of group reports. You can read more about this in our privacy statement. Our privacy statement also explains what information that you fill in will still be visible to you (for example, online questionnaires you completed via the Halo meter will no longer be visible). Halo assumes that you will answer questions asked in the online environment about your situation honestly and to the best of your knowledge.
The login details for the Halo application are strictly personal. This means that you may not transfer these login details and must ensure that other persons do not use your login details or provide your login details to third parties and that your login details do not become available to third parties. If you suspect that your login details may have been disclosed or are otherwise available to unauthorised persons (such as due to a data breach), you must inform Halo of this in writing as soon as possible, but in any event within 24 hours of discovering this.
Making statements within the application that are experienced as offensive, provocative, insulting, discriminatory, intimidating or objectionable or behaviour accompanied by threats, physical violence, vandalism and/or serious disturbance of the public order are prohibited. If Halo observes that you are acting in breach of your right of use and/or in breach of these terms of use, it may take all measures it deems necessary or desirable to put an end to the situation and/or to limit the resulting loss, damage or injury and it may recover any resulting loss from you in full. Halo is not liable for these measures or for any loss or damage resulting from these measures. If the agreement between Halo and your employer or the employment contract between you and your employer ends, you may complete the programme of the Halo environment. At the end of this programme, you will no longer be entitled to use the application.
- What if I receive a reward from a third party?
As a participant, you may be entitled to a reward from a third party for your participation. In that case, we apply the following conditions. If you have earned a reward, Halo will put you in touch with a third party (if the reward concerns a third-party product or service) by providing a one-off non-transferable voucher. If you do not redeem this voucher in good time, the relevant reward will expire. Collecting the reward from a third party gives rise to a legal relationship between you and the third party, in which context you, as a participant, personally choose whether you accept this party’s general terms and conditions. We also recommend that you read this third party’s privacy statement. Halo is thus not a party to this and we cannot be held liable for any loss, damage or injury ensuing from that agreement or any other problems relating to the reward. If you are not satisfied with the reward, you will not be entitled to an alternative reward. In the online environment you can earn Halo points based on your progress. It may be the case that a reward is linked to your number of points. The remainder of your Halo points will lapse on the 84th day of participation. At the start of a new participation, the balance of points in the Halo environment will be zero again.
- Changes to an application of terms of use
Halo can make changes to the terms of use at any time. If Halo makes changes to these terms of use, we will announce this via the application. If you disagree with the change, you can stop using the application at any time. If you continue to play the game, we will assume that you have accepted the new version of the terms of use.
- What if we have a dispute?
These terms of use are governed by Dutch law. The terms of use do not affect any rights the user has as an employee pursuant to mandatory statutory provisions. Any disputes regarding these terms of use will be submitted to the competent court in Utrecht.
